Axom Infotech provides custom software development services including but not limited to web development, mobile application development, AI and machine learning solutions, UI/UX design, DevOps consulting, and related technology services. The specific scope, deliverables, timelines, and pricing for any engagement are governed by a separate Statement of Work (SoW) or Service Agreement signed between Axom Infotech and the client. In case of any conflict between these terms and a signed agreement, the signed agreement shall prevail.

3. Use of Our Website

You may use our website for lawful purposes only. You agree not to: • Use the website in any way that violates applicable local, national, or international laws or regulations • Transmit any unsolicited or unauthorised advertising or promotional material • Attempt to gain unauthorised access to any part of the website or its related systems • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the website • Use any automated tools to scrape, crawl, or systematically extract content from the website without our express written permission • Introduce any viruses, trojans, worms, or other malicious or technologically harmful material We reserve the right to suspend or terminate access to the website for any user who violates these terms.

4. Intellectual Property

All content on this website including text, graphics, logos, images, icons, and software is the property of Axom Infotech or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from this website without our prior written consent. Regarding client work: upon full payment, clients receive full ownership of all custom code and deliverables created specifically for their project. We retain the right to display completed work in our portfolio unless otherwise agreed in writing.

5. Client Obligations

When engaging our services, clients agree to: • Provide accurate, complete, and timely information required to complete the project • Review and provide feedback on deliverables within agreed timelines • Ensure they have the rights to any content, assets, or materials provided to us for use in the project • Make payments in accordance with the agreed payment schedule • Designate an authorised point of contact for project decisions Delays caused by a client's failure to meet these obligations may affect project timelines and could incur additional charges as outlined in the relevant Service Agreement.

6. Payment Terms

Specific payment terms are set out in individual Service Agreements. Standard terms are as follows: • Projects typically require a 30–50% deposit before work commences • Remaining payments are milestone-based as defined in the SoW • Invoices are due within 14 days of issue unless otherwise agreed • Late payments may incur interest at 2% per month on the outstanding balance • We reserve the right to pause work on projects with overdue payments All prices are exclusive of applicable taxes unless stated otherwise.

7. Confidentiality

Both parties agree to keep confidential all non-public information disclosed during the engagement. We will sign a mutual Non-Disclosure Agreement (NDA) upon request before any discovery call where sensitive business information is discussed. This obligation of confidentiality survives the termination of any engagement for a period of 3 years.

8. Warranties and Disclaimers

We warrant that our services will be performed with reasonable skill and care, consistent with industry standards. The website is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Axom Infotech shall not be liable for any indirect, incidental, special, consequential, or punitive damages including but not limited to loss of profits, data, goodwill, or business interruption arising from your use of our website or services. Our total aggregate liability to any client in connection with a specific project shall not exceed the total fees paid by that client for the relevant project in the 12 months preceding the claim. Nothing in these terms shall limit our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Termination

Either party may terminate a service engagement by providing 30 days' written notice. Upon termination, the client shall pay for all work completed up to the termination date. We will deliver all completed work and materials to the client upon receipt of final payment. We may suspend or terminate access to our website immediately and without notice if you breach these terms.

11. Governing Law and Disputes

These terms are governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these terms shall first be subject to good-faith negotiation between the parties for a period of 30 days. If the dispute cannot be resolved through negotiation, it shall be submitted to arbitration in Indore, Madhya Pradesh, India, in accordance with the Arbitration and Conciliation Act, 1996. The language of arbitration shall be English.

12. Changes to These Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes by updating the "last updated" date on this page. Continued use of our website after such changes constitutes acceptance of the revised terms. We encourage you to review these terms periodically.
